Rules applicable to the use of personal data in notarial deeds<\/div>\n
If our office draws up a notarial deed using your personal data, the civil-law notary must comply with the legal regulations governing the processing of personal data:<\/div>\n
\u2022 The civil-law notary must include certain mandatory data, personal or otherwise, in the deed. Your personal data are therefore processed on a legal basis.<\/div>\n
\u2022 The civil-law notary must retain the signed deed containing your personal data in perpetuity.<\/div>\n

\u2022 As soon as the civil-law notary signs the deed, it becomes an official document. This means that no further changes may be made to it, even if the personal data are incorrect. If changes need to be made, the civil-law notary must draw up a new deed in which the change is incorporated.<\/div>\n

Source of personal data processed
<\/strong>If our office processes personal data relating to you, which we have not received from you, this will always take place in the context of the engagement assigned to us. The source of those data will be one of the following:<\/div>\n

\u2022 Public registries, including The Netherlands\u2019 Cadastre, Land Registry and Mapping Agency, BRP, Commercial Business Register, etc.
\u2022 A real estate agent or other adviser in connection with a purchase agreement, to which you are one of the parties
\u2022 Donor<\/p>\n

Forwarding your personal data<\/strong>
Our office will forward your personal data to other parties (third parties) only if this is required by law or if this is actually necessary for the execution of the activities.<\/p>\n

Our office provides personal data to the following recipients:

\u2022 Tax authority
\u2022 Register holders
\u2022 Chain partners who are hired by the client, like real estate agents, mortgage consultants, etc. if permission is granted by the client<\/p>\n

Our office does not forward personal data to non-EU countries nor to international organisations.<\/p>\n

Retention of your personal data<\/strong>
Our office will not retain your personal data any longer than necessary for the purpose for which they were collected, for the execution of statutory tasks and compliance with statutory obligations or for the fulfilment of agreements (for instance, due to time limits). The retention periods stipulated in statutory provisions, for instance those of the Dutch Civil-Law Notaries Act (Wet op het notarisambt), apply. Notarial deeds are retained in perpetuity.<\/p>\n

Your rights relating to personal data processed by our office<\/strong>
If your personal data are processed by our office, pursuant to the General Data Protection Regulation (GDPR) (EU) 2016\/679, you may exercise the rights stated below.
To that end, you must submit a request (preferably in writing) to the contact address stated in this privacy statement. Before granting your request, we will confirm your identity on the basis of a valid identity document first.<\/p>\n

Right of inspection by the data subject<\/strong>
You can always enquire which personal data our office processes, for which purpose they are used and how long the data will be retained. In the event that there is any legal basis that precludes us from complying with your request, we will assess this and inform you accordingly.<\/p>\n

Right to rectification<\/strong>
If you believe that certain data have been incorrectly processed, you have the right to request rectification of the data. This is not possible, however, if the data are used in a notarial deed, in which case a new deed must be drawn up as an addendum to the incorrect deed.<\/p>\n

Right to erasure (right to be ‘forgotten’)<\/strong>
If you wish to have your personal data erased, you may submit a request to that effect. If the data are included in a notarial deed, the civil-law notary is not permitted to erase the data.<\/p>\n

Right to restriction of processing<\/strong>
If you wish to restrict the processing of personal data by our office (pending rectification of your personal data at your request, an objection lodged against processing or because you specifically do not wish to have data erased even though processing of the data is unlawful), you may submit a request to that effect.<\/p>\n

Right to data portability<\/strong>
If your personal data are not processed for the purpose of a notarial deed and you wish to transfer the personal data to another service provider, you may submit a request to that effect. However, please note that such a transfer may not always be possible due to incompatibility with the statutory notarial duties.<\/p>\n

Possible restrictions in exercising your rights under the General Data Protection Regulation (EU) 2016\/679
Our office will make every effort to fulfil your rights under the General Data Protection Regulation (EU) 2016\/679. However, in some cases these rights may conflict with other statutory provisions for instance those of the Dutch Civil-Law Notaries Act. Should the civil-law notary for this reason be unable to fulfil a request relating to the rights described above, you will be notified accordingly in writing.<\/p>\n

Onze dienstverlening<\/strong>
Ons kantoor vraagt uw persoonsgegevens alleen op voor de volgende doelen:
* het uitvoeren van opdrachten voor advies of andere diensten;
* om te voldoen aan wettelijke taken en verplichtingen; of
* voor de doelen waar u specifiek toestemming voor heeft gegeven.
Uw gegevens worden niet zonder uw toestemming voor andere doelen verwerkt.<\/p>

Persoonsgegevens worden opgevraagd voor het opmaken van een notari\u00eble akte of voor het uitvoeren van een andere opdracht.\u00a0<\/span><\/p>

Regels persoonsgegevens bij notari\u00eble akten<\/strong>
Als ons kantoor een notari\u00eble akte opmaakt met uw persoonsgegevens, moet de notaris zich aan wettelijke regels houden. Deze hebben invloed op de verwerking van persoonsgegevens:
<\/span>1. De notaris moet bepaalde (persoons)gegevens verplicht in de akte zetten. Uw gegevens worden dus op een wettelijke grondslag verwerkt.
<\/span>2. De notaris moet de ondertekende akte met uw persoonsgegevens verplicht eeuwig bewaren.
3. Zodra de akte door de notaris is ondertekend, wordt het een officieel bewijsstuk. Dan mag er niets meer aan veranderd worden, ook niet als de persoonsgegevens niet kloppen. Als er wijzigingen nodig zijn, moet de notaris een nieuwe akte maken waarin de wijziging staat.
<\/span>4. De notaris moet bepaalde (persoons)gegevens verplicht controleren in de Basisregistratie Personen (BRP), Handelsregister en Kadaster.
5. De notaris moet verplicht uw identiteit controleren. Hij moet daarvoor een geldig identiteitsbewijs van u opvragen, De notaris is \u00e9\u00e9n van de weinigen die dit ook mag kopi\u00ebren met alle gegevens die erop staan.
<\/span>6. Uw persoonsgegevens vallen onder het beroepsgeheim van de notaris. Onbevoegden krijgen geen toegang tot de gegevens.\u00a0<\/span><\/p>

Adviezen en overige diensten<\/strong>
Voor de overige verwerkingen van persoonsgegevens door ons kantoor geldt:

Bron van verwerkte persoonsgegevens<\/strong>
Als ons kantoor persoonsgegevens van u verwerkt, die wij niet van uzelf hebben verkregen, dan zal dat altijd gebeuren in het kader van de ons verstrekte opdracht. De bron van die gegevens zal dan \u00e9\u00e9n van de volgende zijn:
\u2022 Openbare registers, waaronder het Kadaster, BRP, Handelsregister, etc.
\u2022 Makelaar of andere adviseur in verband met een koopovereenkomst waarin u \u00e9\u00e9n van de partijen bent
\u2022 Schenker
Doorgeven van uw persoonsgegevens<\/strong>
Ons kantoor geeft uw persoonsgegevens alleen aan anderen (derde partijen) door als dat wettelijk verplicht is of als dat echt nodig is om de werkzaamheden uit te voeren.
Ons kantoor verstrekt persoonsgegevens aan de volgende ontvangers:
\u2022 KNB
\u2022 Belastingdienst
\u2022 Registerhouders
\u2022 Door cli\u00ebnt ingeschakelde ketenpartners, zoals makelaars, hypotheekadviseurs, etc, indien toestemming van de cli\u00ebnt<\/p>

Persoonsgegevens worden door ons kantoor niet doorgegeven buiten de EU of aan een internationale organisatie.<\/p>

Bewaren van uw persoonsgegeven<\/strong>s
Uw persoonsgegevens worden door ons kantoor niet langer bewaard dan nodig voor het doel waarvoor zij zijn verzameld, voor het uitoefenen van wettelijke taken en het nakomen van wettelijke verplichtingen of het uitvoeren van overeenkomsten (denk aan verjaringstermijnen). Bewaartermijnen uit wettelijke bepalingen zoals de Wet op het notarisambt en de archiefwet zijn van toepassing. Notari\u00eble akten worden eeuwig bewaard.<\/p>

Uw rechten ten aanzien van door ons verwerkte persoonsgegevens<\/strong>
Wanneer uw persoonsgegevens door ons kantoor worden verwerkt kunt u op grond van de Algemene Verordening Gegevensbescherming van de onderstaande rechten gebruik maken.
<\/span>Dit doet u door een (liefst schriftelijke) aanvraag via de contactgegevens uit deze privacy verklaring. Voor wij uw aanvraag inwilligen, zullen wij u eerst identificeren aan de hand van een geldig identiteitsbewijs.
<\/span>Recht van inzage van de betrokkene
<\/span>U kunt altijd opvragen welke persoonsgegevens ons kantoor verwerkt, voor welk doel dat is en\u00a0 <\/span>hoe lang deze bewaard worden. Mogelijk is er een wettelijke grondslag waardoor we niet op uw verzoek in kunnen gaan, wij zullen dit beoordelen en u hierover informeren.<\/p>

Recht op rectificatie<\/strong>
Wanneer u meent dat bepaalde gegevens niet correct zijn verwerkt, heeft u het recht rectificatie van deze gegevens te vragen. Als dit gaat om gegevens in een notari\u00eble akte, is dat niet mogelijk en zal een nieuwe akte moeten worden opgesteld als aanvulling op de onjuiste akte.
Recht op gegevenswissing (recht op \u2018vergetelheid\u2019)
Wanneer u wilt dat uw persoonsgegevens worden verwijderd, kunt u hiervoor een verzoek indienen. Staan de gegevens in een notari\u00eble akte, dan mag de notaris deze niet verwijderen.<\/p>

Recht op beperking van de verwerking<\/strong>
Wanneer u de verwerking van persoonsgegevens door ons kantoor wil beperken (in afwachting van door u gevraagde rectificatie van uw persoonsgegevens, gemaakt bezwaar tegen verwerking of omdat u juist niet wil dat gegevens worden verwijderd ondanks dat de verwerking onrechtmatig is) kunt u hiervoor een verzoek indienen.<\/p>

Recht op overdraagbaarheid van gegevens<\/strong>
Wanneer uw persoonsgegevens niet worden verwerkt voor een notari\u00eble akte en u de persoonsgegevens wil overdragen naar een andere dienstverlener kunt u hiervoor een verzoek indienen. Een dergelijke overdracht is overigens niet altijd mogelijk, aangezien wettelijke notari\u00eble plichten zich hiertegen kunnen verzetten.
Mogelijke beperkingen in het uitoefenen van uw rechten op basis van de Algemene Verordening Gegevensbescherming
Ons kantoor stelt alles in het werk om te voldoen aan uw rechten op basis van de Algemene Verordening Gegevensbescherming. Het kan echter voorkomen dat deze rechten in conflict zijn met andere wettelijke bepalingen zoals de Wet op het notarisambt. Mocht de notaris om die reden niet aan \u00e9\u00e9n van de genoemde verzoek kunnen voldoen, dan wordt u hiervan schriftelijk op de hoogte gesteld.
Klachten over de verwerking van uw persoonsgegevens door ons kantoor
Wanneer u klachten heeft over de verwerking van persoonsgegevens door ons kantoor dan horen wij dit graag via wessel@bvwn.nl.
U heeft ook het recht een klacht in te dienen bij de toezichthouder, de Autoriteit Persoonsgegevens.
